Because although the All-England Law Reports cites as 2009, the actual date of the publication of the judgment in the House of Lords Reports was October 2008 - one month before my time period starts...

damn.

Looks like I gotta stick to HoL Hansard >.<

well lest you realised, they are really harsh when marking things like that, in my practise Moot, I went from 2-1 to 2-2 because said one case, which she felt was not needed

It's a right git as well because this case would have been PERFECT to show the workings of the Rule of Law in a Judicial Review case >.<
I can't even email my lecturer about it because she explicitly said that no-one is to ask her whether something is alright to use in the essay...

I would risk losing a hell of a lot of marks if I couldn't use it... chances are that she will look up the case citation and read it, and note on my essay that I used a case from outside the time period specified...

WHICH IS ANNOYING BECAUSE THAT'S THE CLEAREST EXPRESSION OF THE RULE OF LAW I HAVE FOUND FOR THIS YEAR >.<

Imma see if I can find another one...
